Solaine Douglas Nutrition will make every effort to ensure a Product is accurately depicted on the Website, however, you acknowledge that the results from clients vary and Solaine Douglas Nutrition is not responsible for the results you get.

Nothing in these Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.

Health Disclaimer and Your Responsibility As A User of This Product

You acknowledge that by purchasing this product you have read the sales page and understand that it is your responsibility to ensure that this product is suitable for you and your health circumstances.

Returns & Refunds Policy

Due to the nature of digital products, we will not offer a refund for a simple change of mind or if you deem the program unsuitable for any reason (as it is your responsibility to determine if the product is suitable to your personal circumstances BEFORE purchase), therefore it is completely up to you to read the product page thoroughly before you make the transaction. Under no circumstances will a change of mind refund be issued. Since the products made available here are intangible, refunds are only considered when the below conditions are met;

A full refund for the PCOS GlowUp will only be issued if:

• It is within 60 days of your purchase date;

   

• The the program is completed including each weeks reflection questions (this is what is used to determine your eligibility for a refund, refunds will not be processed unless these questions are completed);

   

• You are able to explain how the program has not delivered on its promise. Keeping in mind that results will vary person to person and any testimonials are not a guarantee of what you will be able to achieve.

   

Refunds granted are always minus any processing fees incurred to the business by the respective processing company e.g. Stripe or PayPal.

Terms of Use For Payment and Charges

• In using the Purchase Services to purchase the Product through the Website, you will agree to the payment of the purchase price listed on the Website for the Product (the 'Purchase Price'). It is your responsibility to read the sales page carefully and understand the price before you buy.

   

• All payments made are managed by a third party payment gateway, Stripe. All card information is handled over SSL encryption.

   

• In using the Purchase Services, you warrant that you have familiarized yourself with, and agree to be bound by, the applicable Terms and Conditions of Use, Privacy Policy and other relevant legal documentation provided by the Payment Gateway Providers.

   

Ongoing Access to the PCOS GlowUp

You will have ongoing access to the PCOS GlowUp for the duration that Solaine Douglas Nutrition continues to provide this product. This means that while this product is for sale, you will have ongoing access to it.

Solaine Douglas Nutrition does reserve the right to discontinue this product at any time, and remove your access to it. If the product is ever discontinued, you will have a minimum of 4 weeks to complete the GlowUp program.

Facebook Group Rules, Communication with Solaine & The Solaine Douglas Nutrition Team

Purchasing the PCOS GlowUp does not include any email or social media communication with Solaine. Solaine may get back to you via social media but is not required to, as this is not included in the purchase of the GlowUp.

Fortnightly communication with Solaine is reserved for her clients inside The PCOS Pathway. If you have any questions relating to the access of the GlowUp content, or any issues preventing you from moving ahead, please email [email protected] allow 24 hours for a reply Monday to Friday.

The Facebook group included in the GlowUp purchase is not available for asking any detailed questions relating to your PCOS. It is only available to discuss your GlowUp progress and serves as a communication tool to support others and help to keep you accountable.

Please do not ask any personalized nutrition questions, this is outside the scope of the PCOS GlowUp.

Participant Related Content:

During your participation in The PCOS GlowUp program, you may create, appear in, or be mentioned in various materials, including but not limited to images, audio recordings, video recordings, and written content, which may be used for marketing and promotional purposes ("Participant Related Content").

1. Consent to Use: By participating in The PCOS GlowUp program, you irrevocably consent to us using, in perpetuity and without any fee or royalty payable to you, any Participant Related Content for the purpose of marketing The PCOS GlowUp program, future similar programs, and to market and advertise our services generally.
2. Waiver of Inspection: You waive the right to inspect or approve the finished product, including written or electronic copy, wherein your name, likeness, or content appears.
3. Representation and Warranty: You represent and warrant that you have the authority to provide us with the consents set out in this clause regarding Participant Related Content.
4. Release of Claims: You agree to release and hold us harmless from all claims, demands, and causes of action that you have or may have by reason of our use of the Participant Related Content as contemplated in this clause of the agreement.

Termination of Product Access

Solaine Douglas Nutrition reserves the right to discontinue or cancel your access to any products or services at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Purchase Services without notice if you breach any provision of the Terms or any applicable law.

Indemnity

You agree to indemnify Solaine Douglas & Solaine Douglas Nutrition employees, agents, contributors, third party content providers and licensors from and against:

• all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with any Content you post through the Website;
• any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so and any breach by you or your agents of these Terms; and/or
• any breach of the Terms.

Acceptance of Terms and Conditions

You accept the Terms by remaining on the website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by Solaine Douglas Nutrition on the checkout page.

If you do not agree to the terms and conditions contained in this Agreement, Website Terms of Use or our Privacy Policy (or any subsequent amendments) you must cease using our Site and Services immediately.
